Employeurs du Libre contre HADOPI

À l'initiative de l'April, des entreprises dont l'activité repose sur le Logiciel Libre ont adressé un courrier à la ministre de la Culture pour qu'elle prenne en compte le Logiciel Libre dans son projet de loi. Ce courrier demande notamment qu'aucune discrimination ne soit créée à l'encontre des auteurs, éditeurs et utilisateurs de logiciels libres, ainsi qu'une révision de certaines dispositions de la loi DADVSI ayant fait l'objet d'amendements dans le cadre de l'examen du projet de loi HADOPI.

Paris, le 31 mars 2009. Communiqué de presse.

Plus de 80 employeurs du Libre adressent une lettre ouverte à Christine Albanel. Ils se dressent contre les discriminations dont le projet de loi « Création et Internet » (HADOPI) est porteur et exhortent la ministre de la Culture à cesser de pénaliser le secteur français du Logiciel Libre. Les signataires s'opposent notamment aux mouchards filtrant et à tout filtrage imposé, exigent une sécurisation juridique de l'interopérabilité et appellent à revenir sur la loi DADVSI.

The French Law on Confidence in the Digital Economy ["Loi sur la confiance dans l'Economie Numérique" or LCEN] contains, after its passage in second reading in the Senate, measures tending to make the hosts of contents the censors of the "manifestly illicit" contents. April thinks that these measures could be used abusively to prevent the spread of a free software competing with a proprietary software. For April, only a judge should decide on the lawfulness of a content.

April supports the Freebox http://freebox.flouzo.fr/ campaign aimed at protecting the rights of authors of free software. Harald Welte, a developer of iptables, supported by Rob Landley and Erik Andersen Project BusyBox (two software present in all Freebox), calls for compliance with the GNU General Public License they have chosen for their software. Indeed, anyone who uses their work should attribute it to its authors, and any distribution of modified versions of their software makes it compulsory to disclose the sources of these changes.

The terms “Free Software” and “Open Source” are used to characterize the software covered by a license providing freedom to execute, study, redistribute, modify and improve them (see in appendix a more detailed explanation of these elements). Position on the Microsoft/Novell agreement of November 2006

Qualified as “symbolic” by several editors of daily newspapers, the agreement signed by Microsoft and Novell on November 2, 2006 is indeed just such. [1] But it doesn't not make a good news for Free Software. Through buzzwords as “interoperability” or “open standards”, Microsoft managed to divert the journalists' attention from the essence of the agreement: Microsoft only embraces Novell to try to suffocate better Free Software in general.
