Position on the "Intellectual Property Rights Enforcement Directive" (IPRED)

Several points of the European directive on the enforcement of the "rights of intellectual property" ("IP enforcement" or "IPRED") passed by the European Parliament on March 3, 2004 and finally adopted by the European Council on April 27, 2004, worries April:

  • The unclear escalation of the penalties concerning the "intellectual property", a vast ensemble collecting things so diverse as the copyright, the patents, the right of the brands...
  • The automatic character of the right to information which could allow persons to enforce rights, for example on a logo, to get information about opponents;

April thus invites all to be very watchful on the transposition of this "super EUCD".
